WITH THE RIGHT PRIVACY TO THE NEIGHBOR DRIVE OUT THE CURIOSITY

Privacy is very important to most citizens - at least when it comes to their own four walls. If you are often less cautious in the online world, you want to block your own property with an effective privacy screen from Neighbor Naseweis. But not everything is allowed.

WHEN THE PRIVACY SHIELD TRIGGERS DISPUTE TO THE NEIGHBOR

In general, the desire to quarrel among neighbors in Germany goes up. In 2014, one in three still said that they had had serious quarrels in their neighborhood before, and now the quota is 46 percent (source: Statista ). It is striking that one seems to be belligerent, especially in northern Germany.
The figures in detail (respondents with experiences in the neighborhood dispute, indication in percent):
             Northern Germany: 54%
             Middle: 46%
             East Germany: 41%
             Southern Germany: 44%
Most often, the topic is noise pollution (74 percent), followed by cars parked at almost the same amount (53 percent) and non-compliance with neighborly obligations (52 percent). Even disturbing pets affect 48 percent peace in the neighborhood.
Included in the mentioned Neighborhood obligations are things like street cleaning, snow removal, but also the typical "border violations" in the form of hedges, trees, carports or other buildings that could disturb the sense of the neighbors. Even if some privacy shields neighbor and co effectively, not every measure for optical encapsulation is long and appropriate.
The situation is aggravated by the fact that local rules and building regulations often deviate from neighboring law, which sets the limits for the type of privacy.
Broken down by federal states
that Hamburg with 50.2 percent dispute quota leads the table by some margin.
Only second comes with 42.9 percent Baden-Württemberg.
In Hesse (28.8 percent) and Bavaria (25.3 percent), one seems to be more relaxed.
However, you take things quite calmly in the capital. In Berlin, only 13.9 percent of respondents said that they had had a row with their neighbors before.

WHY THE SCREEN SHOULD BE KEPT AWAY FROM THE NEIGHBOR AND PASSERBY

The privacy in your own garden or in your own home can be severely impaired if someone is constantly looking over the fence or into the window. Not everything is meant for strangers eyes (and ears). And not everywhere there is the possibility to close a roller shutter - especially since not everyone wants to sit in the dark. At least in windows and balcony or patio doors, there are relatively simple methods to exclude with an effective privacy neighbor or the intrusive landlord.
The advantage of so-called privacy film is that there are usually no structural changes and the films can be removed later if necessary without leaving residue. This is particularly important in rental housing, where not only a privacy against neighbors, but possibly also against their own landlord is desired. The slides have a large selection, some of which are installed by the company itself. Similar to tinting film in cars, these privacy screens can be easily fixed from the inside.
The windscreen cleaning from the outside is therefore not affected. There are different alternatives for privacy. From mirror foil, which prevents a view of the apartment at least by day at 100 percent, to heavily tinted films, which also provide sun and UV protection and have a climate-regulating effect, there is just about everything. A craftsman is not absolutely necessary for the installation, but for particularly large glass surfaces or hard to reach areas, it is advisable to keep hands away from self-installation.

MAIL FROM THE LAWYER BECAUSE THE PRIVACY SCREENS TO THE NEIGHBOR

The neighbor or the neighbor may feel disturbed by a privacy screen, which is built spontaneously at the property boundary by the craftsman. In addition, most of the federal states have their own rules, some of which are interpreted differently by local statutes of municipalities and cities.
It is therefore relatively easy to make mistakes when constructing a privacy screen. Especially often there is a dispute over so-called privacy fences. Such a fence prevents the direct viewing of a fenced area.
Typical examples are:
Construction of a screen around the entire garden or the entire property
partial fencing through the privacy screen to shield a specific area (eg seating areas of the terrace, a swimming pool or in front of the garden sauna)
A privacy screen can of course be set up to block an unattractive view of the property beyond, for example, if the neighbor has a very unsightly facade or a neglected garden or other aesthetic disturbances exist. In order to fulfill the purpose of privacy, such a fence must therefore maintain a certain height in order to be effective.
A good average is the term "man-high" - which generally corresponds to around 1.80 m. In contrast to normal garden fences, the screen keeps the neighbor and his curious eyes definitely better.
Even with the materials used, there is sometimes conflict between neighbors when the privacy screen is set up.
             From the pure natural hedge
             over wooden fences
             up to stone-filled wire mesh
or plastic / metal versions find many materials use.
If the privacy of neighbor and neighbor disturbs, this is mostly due to the aesthetic feeling, which is more of a subjective matter. But often the existing rules on the subject of privacy are violated by the stand. In general, the privacy fence, as with any other garden fence, is a so-called law fence. These are usually approval-free, provided they do not exceed a certain amount. Also the distanceto the other property must be kept. This is especially true when you realize the privacy of plants (eg a high hedge).
Walls and fences, which serve as normal legal fence and boundary marking, may vary in size depending on the state and sometimes depending on the city or municipality. So in Munich a maximum height of 150 centimeters applies. Overall, the privacy of neighbor and neighbor should not interfere with the use of their own property. The enclosure must fit the local general picture, which is the rule in the street or the residential area.
If it is not a privacy screen, but a pure marking of the neighborhood border, the neighboring right provides that you must obtain a permit from the neighbors. The distance to the property of the neighbor is also defined in the development plans or the neighborhood law.
One can orient oneself at these reference values (which however can vary strongly locally):
Walls and fences as a symbolic border: 40 to 90cm in height
Walls and fences as privacy: 170 to 190cm height
Minimum distance to neighboring property (if not otherwise regulated): 50cm
The wall and fence are considered a dead right enclosure, hedge as a "living" enclosure

WHEN THE HEDGE ANNOYING NEIGHBOR AND CONSORTS AS PRIVACY

Hedges are particularly popular because they allow a natural demarcation that usually does not pose any aesthetic problems (such as with a high concrete wall). But here, too, the legal requirements of the individual states apply. Thus, the erector of a hedge has to fulfill various duties. The care of the green property line is up to him alone - so he has to take care of overhanging branches on the side of the neighbor.
Overhangs are generally not allowed to the safety obligation to satisfy the event of a storm, etc.. However, this also means that the neighbor may not truncate the hedge that does not belong to him without further ado. If he encounters protruding branches, he must ask the owner of the hedge to cut them back to the permitted level. If appropriate, this can be done by setting a deadline. Only then may the neighbor himself lay hands on the hedge - previously it would be a non-permitted property damage.
Moreover, the following rules of thumb apply to plantings:
Plants up to 1m high must keep a minimum distance of 25cm to the other plot
Plants between 1.01m and 1.50m in height must be at least 50cm away
Plants with a height of more than 1,50m have to keep a distance of 75cm

CONCLUSION: ANNOYING THE NEIGHBOR WITH THE PRIVACY SCREEN IS NOT A GOOD IDEA

Anyone who sets up a screen should strictly adhere to the requirements of the respective country law. In addition, it helps to look at the local development plans, some of which can differ significantly from the normal requirements. Depending on the type and minimum distance of the erected fence may require the approval of the neighbors - in the execution of customary enclosures are to be set as a standard.
Special duty of care arises with "living" privacy in the form of a hedge, whose care is the sole responsibility of the owner - and that from all sides. However, effective visual protection can often be achieved by providing windows with privacy screens. Then there is usually no trouble with landlords or neighbors.
